Introduction

The Enforcement Division was established on 17 April 1972 under the Ministry of Trade and Industry (MTI) with the objective of helping the government to curb inflation at that time. On October 27, 1990, the Ministry was restructured to form two ministries namely the Ministry of International Trade and Industry (MITI) and the Ministry of Domestic Trade and Cost Of Living (KPDN). The Enforcement Division was placed under KPDN which is now known as theMinistry of Domestic Trade and Cost Of Living (KPDN).

Some Of The Functions Of Enforcement Division Are:

  1. To tackle issues of rising prices and curb price manipulation in the country at every stage of business through the enforcement of the Price Control and Anti-Profiteering Act 2011 (AKHAP)
  2. To enforce the Festive Season Price Control Scheme (SHMMP) under the Price Control and Anti-Profiteering Act 2011 to protect consumers from traders who would like to take the opportunity to increase prices of main commodities during the festive season.
  3. To eradicate leakage of subsidized control items and stabilize the supply of essential goods by ensuring that they are easily available in the market under the Supply Control Regulations 1974 and the Control of Supplies Act 1961.
  4. To investigate consumer complaints utilizing the law that is enforced to ensure a healthy and ethical business environment.To eradicate unethical business activity in order to protect consumers from being exploited by traders through the Hire Purchase Act 1967, Weights and Measures Act 1972, Direct Selling and Anti-Pyramid Scheme Act 1993, Consumer Protection Act 1999 and Trade Description Act 2011 including sale activities, Door to door sale, hire purchase agreement, verification of weighing and measuring equipment and the use of halal terms.
  5. To issue permits for scheduled controlled items under the Supply Control Act 1961 for the purpose of distribution of controlled items.To protect intellectual property rights under the Copyright Act 1987 for works eligible for copyright protection including works of literature, film, music, sound, art and broadcast.
  6. To promote good trade practices by prohibiting false trade descriptions and false or misleading statements in relation to the supply of goods and services under the Trade Descriptions Act 2011.
  7. To regulate licensing and manufacturing of optical discs under the Optical Discs Act 2000.To assist in the regulation of Franchise activities by ensuring that franchisors and franchisees comply with the laws that is stipulated under the Franchise Act 1998.
  8. To protect intellectual property rights under the Trademark Act 2019 in relation to the protection of registered trademarks and under the Copyright Act 1987.
